1. About Leadfirst

2. Eligibility

If you use Leadfirst to collect information from your customers, visitors, or leads, you are responsible for ensuring that your collection and use of that information complies with applicable laws.

You are responsible for:

Your privacy notices
Consent mechanisms where required
Lawful collection of lead information
Accuracy of information provided by you
Your marketing and communication practices
Compliance with applicable anti-spam and communication regulations

Leadfirst provides technology infrastructure and does not determine whether your specific data collection practices are legally compliant.

6. Third-Party Integrations

Leadfirst may connect with third-party platforms and services.

Examples may include payment gateways, advertising platforms, CRM systems, website builders, email providers, SMS providers, WhatsApp providers, and other external services.

Third-party services are controlled by their respective providers. We are not responsible for:

Third-party downtime
Changes to third-party APIs
Third-party account restrictions
Third-party pricing changes
Third-party data policies
Suspension or termination of third-party services

7. Payments and Subscriptions

Certain Leadfirst features may require payment.

Prices, billing periods, usage limits, and included features will be displayed at the time of purchase.

Unless otherwise stated:

Payments must be completed through the available payment methods.

Completely error-free
Free from temporary downtime
Compatible with every third-party service
Available with every feature at all times

Maintenance, upgrades, security incidents, infrastructure failures, and third-party dependencies may occasionally affect availability.

9. Intellectual Property

Leadfirst, including its software, interface, branding, logos, designs, documentation, and underlying technology, is owned by or licensed to Techwix Private Limited unless otherwise stated.

You receive a limited, non-exclusive, non-transferable right to use the service during your valid account or subscription period.

You may not copy, modify, reverse engineer, resell, reproduce, or commercially exploit the platform except as expressly permitted by us.

10. Customer Content

You retain ownership of content and information that you submit to Leadfirst.

You grant Techwix Private Limited the limited rights necessary to host, process, transmit, display, and otherwise process such content solely for providing and improving the services, subject to applicable law and our Privacy Policy.

11. Suspension and Termination

We may suspend or terminate an account where reasonably necessary, including for:

Violation of these Terms
Fraudulent activity
Security concerns
Abuse of the platform
Non-payment
Illegal activity
Excessive or abusive resource usage

Where reasonably possible, we may provide notice before suspension or termination.

12. Disclaimer

Leadfirst is provided on an "as available" basis.

We do not guarantee that using Leadfirst will result in:

A particular number of leads
Sales
Revenue
Advertising performance
Conversion rates
Customer acquisition
Business growth

Business outcomes depend on factors outside our control.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Techwix Private Limited shall not be liable for indirect, incidental, special, consequential, or business losses arising from the use or inability to use Leadfirst.

This may include loss of profits, revenue, business opportunities, data, or goodwill.

Nothing in these Terms is intended to exclude liability that cannot legally be excluded under applicable law.

14. Indemnification

You agree to indemnify and hold harmless Techwix Private Limited, its officers, employees, and service providers from claims, damages, losses, liabilities, and expenses arising from:

Your unlawful use of Leadfirst
Your violation of these Terms
Your violation of third-party rights
Your collection or use of lead data
Content submitted through your account
Your violation of applicable laws

15. Changes to Services

We may modify, add, remove, or discontinue features from time to time.

Where a material change significantly affects a paid service, we may provide reasonable notice where appropriate.

17. Governing Law

These Terms shall be governed by the laws of India.
